1. Scope and Provider

These Terms and Conditions ("Terms") govern the purchase and use of QueryGlow software ("the Software"). The provider is:

By purchasing or using the Software, you ("the Customer") agree to these Terms. If you do not agree, do not purchase or use the Software.

2. Product Description

QueryGlow is a self-hosted database management GUI. Upon purchase, the Customer receives access to a private GitHub repository containing the Software's source code. The Software runs entirely on the Customer's own infrastructure.

3. Contract Formation

A binding contract is formed when:

  1. The Customer completes the checkout process on queryglow.com.
  2. Payment is successfully processed by Stripe.
  3. The Customer receives a confirmation email with repository access.

6. Right of Withdrawal (Widerrufsbelehrung)

6.1 Withdrawal Right

If you are a consumer (a natural person acting for purposes outside your trade, business, or profession), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the day the contract is concluded (the date of purchase).

To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g., a letter or email). You may use the following contact:

6.2 Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will use the same means of payment as you used for the initial transaction.

6.3 Loss of Withdrawal Right for Digital Content

By completing your purchase and agreeing to these Terms at checkout, you:

  1. Expressly consent to immediate delivery of the digital content (repository access) before the withdrawal period expires.
  2. Acknowledge that you thereby lose your right of withdrawal once access to the repository is granted.

This is in accordance with § 356 Abs. 5 BGB and Art. 16(m) of the EU Consumer Rights Directive.

In plain terms: Because you receive immediate access to the full source code, refunds are not possible after access is granted.

7. License Terms

The use of the Software is governed by the QueryGlow License Agreement, which is incorporated into these Terms by reference. Key points:

8. Updates

Your purchase includes access to all updates within the current major version (1.x). Future major versions (2.x and beyond) may require a separate purchase or upgrade fee, at our discretion. You will retain access to all 1.x versions indefinitely.

9. Support

We provide email-based support for installation issues and bug reports. Response times are typically within 48 business hours. Support is provided in English and German.

10. Use at Your Own Risk

QueryGlow is a database management tool. By its nature, it can read, modify, and delete data in your databases. YOU USE THIS SOFTWARE ENTIRELY AT YOUR OWN RISK.

The Customer acknowledges and accepts that:

  • Database operations performed through the Software may result in permanent data loss.
  • The Software may contain bugs that could cause data corruption or unintended modifications.
  • The Customer is solely responsible for maintaining adequate backups of all databases.
  • The Customer must test thoroughly in a non-production environment before use on production systems.
  • The Customer is responsible for securing access to their QueryGlow installation.
  • The Licensor has no access to and no responsibility for the Customer's databases or data.

We strongly recommend: Always have backups. Always test first. Never run on production without testing.

11. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or compatible with all systems. The Customer is responsible for testing the Software in their environment before using it in production.

12. Limitation of Liability

To the maximum extent permitted by law:

This limitation does not apply to damages caused by willful misconduct or gross negligence, or to liability that cannot be excluded under applicable law.

13. License Termination

We may terminate your license and revoke repository access if you:

Upon termination, you must delete all copies of the Software. No refund will be provided for termination due to violation.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

For business customers (B2B), the exclusive place of jurisdiction is Aachen, Germany.

For consumers (B2C), mandatory consumer protection laws of your country of residence may apply in addition to German law.

15. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. For existing customers, material changes will be communicated via email. Continued use of the Software after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
